Part 1: Introduction to the Health Insurance Portability and Accountability Act (HIPAA) and the California Confidentiality of Medical Information Act (CMIA)
A historical overview of the privacy, security and confidentiality rules and how they apply to health care organizations; the Health Information Technology for Economic and Clinical Health (HITECH) Act and associated Breach Notification Rules; the HIPAA Omnibus Rule; a brief overview of Patient Rights under HIPAA and California Laws and a general overview of reporting and disclosure requirements will be summarized.

Part 2: Practical Applications of HIPAA and CMIA in Use and Disclosure
An overview of practical applications in the use and disclosure of protected health information will be discussed. Topics include general medical record definitions, the Privacy Rule, general release of patient information, use or disclosure requiring an authorization and use or disclosure not requiring an authorization.

Part 3: Patient Access Requirements, Patient Portals 
An update on a patient’s right to access health information which is regulated by both federal and state law will be shared. Types of access, exceptions to the right of access, access by minors, denial of access, amendments, patient directed access, third party requests for records, and patient portals will be described.

Part 4: Subpoenas, Attorney Requests for Medical Information, Law Enforcement Requests, e-Discovery, Metadata, Custodian of Records 
A review of the process for accepting and responding to subpoenas will be provided. A discussion of the HIPAA patient notification and CMIA notice to consumer requirements will be described. Also covered during this session is information regarding attorney requests for medical information, law enforcement requests, and e-Discovery. Metadata will be defined, and examples will be provided. The concept of a “Custodian of Records” will also be reviewed.

Part 5: Substance Use Disorder & Mental Health Records, HIV Reporting
A review of the federal and state regulations covering release of records for patients with substance abuse and psychiatric illnesses will be provided. The HIPAA regulations and Lanterman-Petris-Short (LPS) Act will be reviewed. Also included will be discussion regarding disclosure of HIV test results.

    Overview: This publication is designed to inform health information management and other health care professionals about the HIPAA privacy and security rules that include the California Preemption rules. It will go a long way towards familiarizing the reader with the new world of health information confidentiality, as governed by HIPAA and California state law. CLICK HERE to view sample pages.

    In 2003, the rules governing the release of health information became an amalgam of HIPAA and California confidentiality law. Under the ’’preemption’’ doctrine, California providers asked to release protected health information will have to compare HIPAA and relevant state law and CMIA, and then follow the ’’more stringent’’ rule.

    This publication reviews situations where providers are called upon to disclose information -- including releases pursuant to court orders, subpoenas, reporting requirements, patient treatment regimens, and billing and payment activities. A complete appendix of Legal References is included.

    The publication also covers: HIPAA Omnibus Rule [applies to all records, not just electronic]; HIPAA and California Law Enforcement and Penalties; Disclosures to Law Enforcement Agencies; Security Breach; Disclosures permitted by HIPAA and not recognized by CMIA; HIPAA Security Rules; and California Security Requirements.     Kristin Bumroongchart, MPH, RHIA, CHPS
    Manager, Health Information Management, Sharp Rees-Stealy Medical Centers

    Kristin Bumroongchart has worked in the HIM field for almost 25 years, primarily focused on health information technology, release of information, and ambulatory care. Her areas of responsibility include oversight of release of information for four acute care and three specialty care hospitals in addition to HIM operations at a 600+ provider multi-specialty medical group. She has a master’s in public health, with an emphasis in health management and policy, and is passionate about creating meaningful and positive health care experiences.

    Healthcare Compliance Consultant and Educator  

    Wanda Ziemba has been involved in the health care arena for over 30 years and is currently the HIT Program Director at City College of San Francisco and teaches HIM courses at Santa Barbara City College. She graduated from Concord Law School in December 2010, receiving an Executive Juris Doctorate in Health Law. She has extensive legal training in health care issues and experience serving as a liaison between health care organizations and regulatory bodies, which provided her with a sound foundation for negotiating complex health care delivery and reimbursement issues.
