Attendees will gain a strong foundation in the fundamentals of information release, covering the entire process from request receipt to processing. Key topics include subpoenas, custodian testimony, government requests, and the handling of sensitive records such as minors' health information, mental health, substance abuse, gender-affirming care, psychotherapy notes, and reproductive health records.

Attendees will be able to:

  • Identify who is authorized to consent to the release of health records or PHI
  • Explain the minimum requirements for CMIA and HIPAA-compliant records release authorization form
  • Offer guidance related to the release of sensitive information, such as details about sexually transmitted diseases, reproductive health, drug/alcohol abuse or psychotherapy notes
    • Examine issues related to the release of minors’ health records
    • Review the potential denial of a records release request
    • Provide information related to charging fees for copies of health records
  • Discuss other records release considerations, such as maintenance of original records, tracking disclosures of PHI and documenting the release of health records.

Day one of the ROI Academy will walk attendees through the “what,” “when,” and “why” of releasing protected health information, focusing on the fundamentals of release across the continuum of care, including pediatrics, mental health, reproductive health, substance abuse and sensitive records.

Attendees will:

  • Learn the basics of release of information
  • Understand how to receive and manage requests based on requester and content requested
  • Gain an understanding of special laws pertaining to pediatrics, mental health, reproductive health and other sensitive topics.

Session Description

Fundamentals of Subpoenas, Workers Comp and Government Requests
Presenter: Wanda Ziemba, EjD, MSET, MFA, RHIT, CCS, CHCO/CHCC, CHC, CPC and Alex Nuno, RHIT

Regulations pertinent to health information release require a thorough knowledge of the applicable federal and state laws and guidance. Location of these laws, monitoring changes and using the information correctly is paramount to a solid foundation in the management of subpoenas and other government requests.

Attendees will:

  • Understand how to review a subpoena request, different types of subpoenas and how to validate if the subpoena is acceptable
  • Evaluate requests for adults, minors, mental health, substance abuse, sensitive records, reproductive health and other considerations
  • Learn how to easily locate relevant laws
  • Recognize which laws are applicable and how to use primary law in the context of the government request
  • Use the regulatory content to develop policies and procedures to manage a response to the request
  • Develop a custom toolbox for subpoena law compliance

Her areas of responsibility include oversight of release of information for four acute care and three specialty care hospitals in addition to HIM operations at a 700+ provider multi-specialty medical group. She has a master's in public health with an emphasis in health management & policy and is passionate about creating meaningful and positive healthcare experiences.

How to Access Live eLearning Program For advanced purchases received one (1) business day prior to event date, access will be made available the morning of the live program.

Live Program access and materials will be accessible exclusively via the registrant’s  CHIA User Profile. Registrants will be given access to an eLearning Program Access Group page (restricted access) that will include the LIVE event link and program evaluation.

How to Access Program Materials If handouts were provided by the speaker they can be found in CHIA’s Learning Management System .
How to Access On-demand Program Recording (included) All eLearning Programs include on-demand access of the live program recording to stream. Allow up to three (3) business days after the live program for availability in CHIA’s Learning Management System .

2. Once logged in, you should automatically be directed to your dashboard. If not, click on the "My Dashboard" link at the top of CHIA's homepage.

    

3. Hover over"My Learning" and select "Live eLearning Programs"from the top menu bar.

  

4.  Select the appropriate eLearning Program, once on the program group page, you will find all the program access information.
