With patients now asking to access and get copies of their records in record volumes, new rules, timelines, and regulatory requirements have been implemented with the 21st Century CURES Act and Information Blocking. Healthcare organizations must address operational policies and practices that mitigate the risks of blocking protected health information for patients.
Attendees will learn answers to these and additional challenging questions in the complex world of information blocking, electronic health information (EHI), and release of information:
1. When a medical record request from a patient comes in, can patients be directed to a patient portal?
2. Can records be held if there is an outstanding patient balance?
3. Can fees be charged for the reproduction of health records?
4. What penalties are medical providers being subject to for information blocking?
5. Do all records have to be released upon patient request or are there exclusions?
6. What is the designated record set and its implication to information blocking practices?
7. What are the rules for timely access to protected health information and its release?
8. If a practice/organization doesn't have the staff to produce records in a timely manner, are they exempt?
9. Is a signature needed to release records along with a patient ID?
10. What changed in 2023 that needs to update in the healthcare organization’s policies, procedures and compliance programs?
