‘Tis the Season for Student Scholarships | Apply by 3/1

Funding Approved by the CHIA Board of Directors | Six (6) Scholarships of $750 

It is the season for student scholarship applications. CHIA annually awards up to six (6) student scholarships of $750 to Emerging Professional (Student) Members to assist in completing their educational goals in CAHIIIM-accredited health information administration (HIA) or health information technology (HIT) programs. Candidates also include CHIA Professional Members enrolled in HIA or HIT programs seeking specialty or higher HI-related credentials beyond their status (e.g. CCS or CCS-P pursuing RHIT or RHIA) or enrolled in a post-graduate degree program in an HI-related field. Applications accepted through March 1, 2025.

Advocacy ‘State of the Union’ from Brian Faust

The 2023-2024 Session of the California legislature ended earlier this Fall and following the November elections a new two-year session will begin in January 2025. 

During the just-ended 2023-24 Legislative session, the CHIA Legislative and Advocacy Committee identified and followed 146 proposed bills with potential impacts on health information management. 36 passed and became law, and 21 of them were closely followed by the committee. The Governor vetoed eleven other bills passed by the legislature. All 2024 bills passed this year go into effect January 1, 2025.

Artificial intelligence (AI) caught the attention of the state legislature and three AI-related bills on the CHIA “Watch List” passed and became law:

AB 3030 requires providers using AI to generate patient communications to include a disclaimer that communications were generated by AI and how a patient may contact a “human” health care provider.

SB 942, although not healthcare specific, AB 942 implements a wide-ranging California AI Transparency Act with potentially multiple implications for healthcare.

SB 1120 requires health care plans that use AI (or algorithms or any tools) for utilization review to ensure compliance with specified requirements and its use is fairly and equitably applied.

On the national level, AHMIA continues to aggressively promote the passage of the Patient Matching and Transparency in Certified Health IT (MATCH IT) Act of 2024.

Artificial Intelligence (AI) Key to Assembly Bill No. 3030

Approved by the Governor and Filed with Secretary of State September 28, 2024. 

AB 3030 will require a health facility, clinic, physician’s office, or office of a group practice that uses generative artificial intelligence to generate written or verbal patient communications pertaining to patient clinical information, as defined, to ensure that those communications include both (1) a disclaimer that indicates to the patient that a communication was generated by generative artificial intelligence, as specified, and (2) clear instructions describing how a patient may contact a human health care provider, employee, or other appropriate person. The bill would exempt from this requirement a communication read and reviewed by a human licensed or certified health care provider. Under the bill, a violation of these provisions by a physician would be subject to the jurisdiction of the Medical Board of California or Osteopathic Medical Board of California, as appropriate.

Discover AHIMA Tool for HI Professionals Regarding Reproductive Health Decisions & Release of Information

Decision Tree for Completing Personal Health Information (PHI) Request in Support of Reproductive Health Care Final Rule

The Final Rule strengthens the Health Insurance Portability and Accountability Act of 1996 (HIPAA) Privacy Rule by prohibiting the disclosure of PHI related to lawful reproductive health care in certain circumstances. Specifically, if PHI is requested to conduct a criminal, civil or administrative investigation for mere act of seeking, obtaining, or facilitating reproductive health care or identifying any person for purpose of conducting such investigation is prohibited. For additional details, please refer to HIPAA Privacy Rule to Support Reproductive Health Care Privacy Final Rule.
