Legislative & Advocacy Attention: Assembly Bill 302

“Brian’s Bill News” | You and 302 | CA Confidentiality of Medical Information Act Changes

Assembly Bill AB302, introduced by Assembly member Rebecca Bauer-Kahan, proposes changes to the California Confidentiality of Medical Information Act (CMIA Act). Its intent to narrow the exceptions under which medical information may be disclosed, particularly as it relates to reproductive health care, is of special interest to health information (HI) professionals.

The CMIA Act prohibits providers from disclosing medical information without obtaining the patient’s authorization except as provided in sections (b) and (c) of the Act. Currently section (b) subsection (1) permits providers to disclose medical information without patient authorization when compelled by “A court order”.  AB 302 amends subsection (b)(1) to read: when compelled by “A California state court pursuant to an order of that court or a court order of another state based on another state’s law so long as that law does not interfere with California laws, including, but not limited to, the Reproductive Act.”  AB302 also makes a similar amendment to section (b) subsection (6) regarding search warrants.

Another provision of the CMIA Act currently allows providers “to the extent expressly authorized by a patient or enrollee or subscriber” to “share, sell, use for marketing, or otherwise use medical information for a purpose not necessary to provide health care services to the patient”. Similar requirements also apply to contractors and subcontractors. AB302 proposes the elimination of the “to the extent expressly authorized” provision and thus would effectively prohibit the use of medical information for any purpose other than those expressly permitted by the CMIA Act.
